This Privacy Policy describes the information privacy practices of Eyemart Express LLC (“Eyemart Express,” “we,” “us,” or “our”), for our brands Eyewear Express, Vision-4-Less, Vision for Less, and Visionmart Express. This Privacy Policy explains what information we collect about you; how we collect that information; the purpose for collecting it and how it benefits you; the outside parties we share it with; and your rights, including what you can do regarding your information.

This Privacy Policy describes how we treat personal information collected by or on behalf of Eyemart Express when you use our websites located at eyemartexpress.com, eyemartexpressonline.com, visionmartexpress.com, vision4less.com, visionforless.com, eyemartonline.com, eyemartoffers.com, drbarneseyewearexpress.com, and drbarneseyecare.com, as well as any other websites and platforms where this Privacy Policy is referenced or found (collectively, the “Site”); in our email messages to you relating to the Site; and in our offline interactions where this Privacy Policy is referenced. This Privacy Policy does not apply to other Eyemart Express websites or platforms that have a different privacy policy. Our Site is intended for use only in the United States and is subject to U.S. laws. If you live outside of the United States, you understand and agree that we may transfer your information to the United States.
This Privacy Policy also does not apply to protected health information (as that term is defined in the Health Insurance Portability and Accountability act of 1996, or HIPAA) we collect or create about you. Instead, our Notice of Privacy Practices applies to protected health information. Please note that most areas of the Site are not intended or designed to collect protected health information. Please do not include any health information when contacting us through the Site, except in areas where this is requested (such as when scheduling an appointment).
By accessing or using the Site, you confirm that you have read, understand and acknowledge the terms of this Privacy Policy, and agree to our Terms of Use.
1. We collect and use personal information about you.
We (and the vendors that perform services on our behalf and other parties) collect, receive, and develop several different types of personal information about you depending on the nature of your interactions with us. For example, we collect:
Identifiers/Contact Information: We may collect your name, email address, social media handles, mailing address, zip/postal code, and phone number. If you create an account, we also collect your username and password. We also collect identifiers that you post to our Site.

Location Information: We may passively collect information about your geolocation when you access our Site. We also collect information about your location using your IP address and your zip code, such as when you search online for product retailers near you.
Demographic Information: We may collect demographic information, such as your age, date of birth or gender. We might also collect information about the age ranges of others in your household.
Employment-Related Information: If you apply for a job, we may collect information about your work experience and previous employment, your education history, your resume, the URL to your personal or professional websites, your workplace skill sets and certifications, whether you need a visa to work in the United States, and salary expectations. If you apply for a job, you can choose to also voluntarily provide any of the following information: ethnicity, gender, disability status, and/or veteran status.
Visual/Audio Information: For example, we may record audio during customer service calls.
Sensitive Information: We may collect information that may be considered sensitive personal information under certain state or local laws. For example, we may collect information that reveals citizenship status, race, ethnicity, religion, or trade union status. We may also collect your precise geolocation and the username and password any account you create with us.
Information you submit or post: We collect feedback and any other information you provide when you contact us.
We collect and develop Inferences. Using the other pieces of personal information collected about you, we draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.
2. We use personal information for the purposes described below.
We use personal information for marketing purposes. For example, we use your information to tailor and send you information about new products and special offers. We also use information to tailor and serve you ads about products and offers. These might be offers from Eyemart Express or others and might include brands, products or services we think you would find interesting.
We use personal information to develop and improve our products and services. We may use your information to make our Site and products better. We use your information to customize your experience. We may also use your information to conduct research and to develop new products and services.

3. We collect personal information about you from various sources, directly and indirectly.
We collect personal information directly from you. For example, we may collect information when you register an account or otherwise contact us.
We collect personal information from your devices. We use technical tracking tools that work behind the scenes, like browser cookies, beacons, and pixels, to automatically collect information from and about you and your devices. We collect this information when you interact with our Site, our ads, and our emails that we or our vendors send to you. We collect this information about users over time and across devices.
We get personal information from vendors we hire to work on our behalf. For example, vendors that host or maintain our Site and send promotional emails for us may give us information. Our employment and recruiting vendors also give us information.

We work with business and marketing partners and social media platforms that give us information about you that they have collected either directly or indirectly from you. We share personal information with vendors that perform services on our behalf for our own business and operational purposes. 5. You have choices and rights regarding our use of your personal information.
You can opt-out of receiving our marketing emails. To stop receiving our promotional emails, follow the instructions in any promotional message you get from us. Some of our websites allow you to modify your preferences to opt-out. Even if you opt-out of getting marketing messages, we will still send you transactional messages, such as responses to your questions.

This California Privacy Notice applies to California residents and provides certain details regarding how we handle your personal information and the rights you have as a California resident regarding your information. This California Privacy Notice supplements our Privacy Policy.

We also disclose categories of personal information as we may describe to you from time to time or as permitted or required by law. - Limit the Use/Disclosure of Sensitive Personal Information – You can request that we limit the use or disclosure of your sensitive personal information to those purposes set forth in applicable California law, subject to certain exceptions.
- Do Not Sell or Share My Personal Information – You can request that we not sell or share your personal information to a third party by clicking here. For purposes of this Section 6, “sell” means the sale, rental, release, disclosure, dissemination, availability, transfer, or other oral, written, or electronic communication of your personal information to an outside party for monetary or other valuable consideration, subject to certain exceptions in applicable law. For purposes of this Section 6, “share” means transferring, making available or otherwise disclosing your personal information to another party for purposes of sending advertising to you based on your personal information obtained from your activities across distinctly-branded sites. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.
We will take reasonable steps to verify your identity prior to responding to certain of your requests. The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us.
You may designate an authorized agent to make a request on your behalf. When submitting the request, please ensure the authorized agent is identified as an authorized agent.
From time to time, we may collect personal information, such as email addresses, in connection with a promotion, offer or discount. Our offers and incentives generally reflect the value of the relationships that we have with the individuals who participate in these programs. In addition to the above, if you reside in California, you also have the right to ask us one time each year if we have disclosed personal information to third parties for their direct marketing purposes. 7. Your Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia Privacy Rights.
If you are a resident of Colorado, Connecticut, Montana, Oregon, Texas, Utah, or Virginia you may make the following requests with respect to your personal information in accordance with applicable law and subject to exceptions set forth in such applicable laws:

- Opt-Out of Targeted Advertising: We may use personal information obtained (or in some instances inferred) from your activities across unaffiliated sites to send more relevant advertising to you. You can request that we stop using your personal information for such targeted advertising.

If you are a resident of Colorado or Connecticut, you may designate an agent to submit an opt-out of sale and opt-out of targeted advertising request on your behalf. Proof to verify your identity and the authorized agent’s authority to submit requests on your behalf is required, or we may deny the request. We use commercially reasonable efforts to authenticate your identity and the authorized agent’s authority through the written documentation provided in connection with the opt-out request in accordance with this Privacy Policy.
From time to time, we or our vendors on our behalf may collect personal information in connection with a promotion, offer, program, discount or other benefits. We or our vendors may disclose such personal information to the categories of third parties described in Section 4 of this Privacy Policy.
8. Our Site is intended for individuals in the United States.
Our Site is hosted in the United States and is intended for United States visitors. If you are visiting from outside the United States, note that United States laws may not provide the same level of protections as those in your own country. If you access our Site from outside of the United States, you understand, consent, and agree that we may transfer your personal information to the United States. If you click on a link to an outside party site, you will be taken to websites or platforms we do not control. This Privacy Policy does not apply to the privacy practices of that website or platform. Read the privacy policies of other websites and companies carefully. We are not responsible for these outside party practices.
We keep personal information as long as reasonably necessary to carry out the business and commercial purposes described in this Privacy Policy or any other notice provided at the time of data collection, to provide our goods and services, and as necessary to comply with our legal obligations, resolve disputes, protect and defend our legal rights, and enforce our agreements.
