This Privacy Policy describes the information privacy practices of Eyemart Express LLC (“Eyemart Express,” “we,” “us,” or “our”). This Privacy Policy explains what information we collect about you; how we collect that information; the purpose for collecting it and how it benefits you; the outside parties we share it with; and your rights, including what you can do regarding your information.

This Privacy Policy describes how we treat personal information collected by or on behalf of Eyemart Express when you use our website located at https://www.eyemartexpress.com or any other websites and platforms where this Privacy Policy is referenced or found (collectively, the “Site”), , in our email messages to you relating to the Site, and in our offline interactions where this Privacy Policy is referenced.  This Privacy Policy does not apply to other Eyemart Express websites or platforms that have a different privacy policy. Our Site is intended for use only in the United States and is subject to U.S. laws.  If you live outside of the United States, you understand and agree that we may transfer your information to the United States.

By accessing or using the Site, you confirm that you have read, understand and acknowledge the terms of this Privacy Policy, and agree to our Terms of Use.

1. We collect and use personal information about you.

We (and the vendors that perform services on our behalf and other parties) collect, receive, and develop several different types of personal information about you depending on the nature of your interactions with us.  For example, we collect:

Identifiers/Contact Information: We may collect your name, email address, social media handles, mailing address, zip/postal code, and phone number. If you create an account, we also collect your username and password. We also collect identifiers that you post to our Site. 

Purchase and Preference Information: We may collect your order history, such as what products you have purchased or browsed through our Site.  We may also collect your product and shopping preferences.  

Internet and Network Activity Information: We may collect your IP address when you visit our Site. We also use tracking tools like cookies and pixels to passively collect information about how you interact with our Site and online content.  This might include device identifiers, the type of browser and operating system you are using, your browsing and search history on our Site, what areas of our Site you visit and for how long, what products or content you view and click on, what site you came from to get to us and what site you go to when you leave us, and your interactions with our digital ads and content on other sites. Payment Information: We collect billing information, such as your account number, credit card number, expiration date, card verification number, and billing address if you make a purchase.

Visual/Audio Information: For example, we may record audio during customer service calls.

We collect and develop Inferences. Using the other pieces of personal information collected about you, we draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.

  • Correction – You can request that we correct inaccurate personal information that we maintain about you, subject to certain exceptions.
  • Limit the Use/Disclosure of Sensitive Personal Information – You can request that we limit the use or disclosure of your sensitive personal information to those purposes set forth in applicable California law, subject to certain exceptions.
  • Do Not Sell or Share My Personal Information – You can request that we not sell or share your personal information to a third party by clicking here. For purposes of this Section 6, “sell” means the sale, rental, release, disclosure, dissemination, availability, transfer, or other oral, written, or electronic communication of your personal information to an outside party for monetary or other valuable consideration, subject to certain exceptions in applicable law.  For purposes of this Section 6, “share” means transferring, making available or otherwise disclosing your personal information to another party for purposes of sending advertising to you based on your personal information obtained from your activities across distinctly-branded sites. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.

We will take reasonable steps to verify your identity prior to responding to certain of your requests.  The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us.

You may designate an authorized agent to make a request on your behalf.  When submitting the request, please ensure the authorized agent is identified as an authorized agent.

From time to time, we may collect personal information, such as email addresses, in connection with a promotion, offer or discount.  Our offers and incentives generally reflect the value of the relationships that we have with the individuals who participate in these programs. Participation in these programs is voluntary and you may withdraw at any time by emailing us at privacyofficer@eyemartexpress.com, or by calling us at 1-888-372-2763.

In addition to the above, if you reside in California, you also have the right to ask us one time each year if we have disclosed personal information to third parties for their direct marketing purposes. 7. Your Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia Privacy Rights. 

If you are a resident of Colorado, Connecticut, Montana, Oregon, Texas, Utah, or Virginia you may make the following requests with respect to your personal information in accordance with applicable law and subject to exceptions set forth in such applicable laws:

  • Access: You can request to confirm whether we process your personal information. Subject to certain exceptions, you can also request a copy of your personal information. You may also request that we provide a list of third parties to which we disclosed personal information as set forth under applicable law.
  • Deletion: You can request that we delete personal information we have from or about you, subject to certain exceptions.
  • Correction: You can request that we correct inaccurate personal information we maintain about you, subject to certain exceptions.
  • Opt-Out of Sale: We may “sell” personal information about Colorado and Connecticut residents as the term is defined under applicable state laws. You can request to opt out of the sale of your personal information to a third party.
  • Opt-Out of Targeted Advertising: We may use personal information obtained (or in some instances inferred) from your activities across unaffiliated sites to send more relevant advertising to you. You can request that we stop using your personal information for such targeted advertising.

We may “sell” (as such term is defined in applicable Colorado and Connecticut law) and process for targeted advertising purposes the following categories of personal information, including for cross-context behavioral advertising: identifiers and contact information; personal records; personal characteristics or traits; commercial information; internet and other electronic network usage information; geolocation information; audiovisual and similar information; and inferences. We may “sell” or share these categories of personal information to or with the categories of third parties described in  of this Privacy Policy. If you are a resident of Colorado or Connecticut, you may designate an agent to submit an opt-out of sale and opt-out of targeted advertising request on your behalf. Proof to verify your identity and the authorized agent’s authority to submit requests on your behalf is required, or we may deny the request.  We use commercially reasonable efforts to authenticate your identity and the authorized agent’s authority through the written documentation provided in connection with the opt-out request in accordance with this Privacy Policy.

 

From time to time, we or our vendors on our behalf may collect personal information in connection with a promotion, offer, program, discount or other benefits. We or our vendors may disclose such personal information to the categories of third parties described in of this Privacy Policy.

 

8. Our Site is intended for individuals in the United States.

Our Site is hosted in the United States and is intended for United States visitors. If you are visiting from outside the United States, note that United States laws may not provide the same level of protections as those in your own country. If you access our Site from outside of the United States, you understand, consent, and agree that we may transfer your personal information to the United States. If you click on a link to an outside party site, you will be taken to websites or platforms we do not control. This Privacy Policy does not apply to the privacy practices of that website or platform. Read the privacy policies of other websites and companies carefully. We are not responsible for these outside party practices.

We keep personal information as long as reasonably necessary to carry out the business and commercial purposes described in this Privacy Policy or any other notice provided at the time of data collection, to provide our goods and services, and as necessary to comply with our legal obligations, resolve disputes, protect and defend our legal rights, and enforce our agreements.

This Consumer Health Data Privacy Policy (this “Policy”) describes how Eyemart Express LLC (“Eyemart Express,” “we,” “us,” or “our”) collects, uses, and shares consumer health data (as that term is defined by applicable laws in Nevada and Washington). We ask that you review it carefully. This Policy describes how we treat consumer health data collected by or on behalf of Eyemart Express when you use our website located at https://www.eyemartexpress.com/pages/store-locator?query=reference or any other websites and platforms where this Policy is referenced or found (collectively, the “Site”), in our email messages to you relating to the Site, and in our offline interactions where this Policy is referenced.  By providing us with consumer health data or using or accessing our Site, you agree to the collection, use, and disclosure of your consumer health data, as described in this Policy.  If you do not agree, please do not provide us with consumer health data and do not access or use the Site or our services.

This Policy supplements the Eyemart Express Ecommerce Privacy Policy and applies solely to consumer health data, as described above.

We may share your consumer health data with your health care professionals and our business partners.  

We may also disclose your consumer health data (a) to vendors that provide business, professional, or technical support functions for us, help us operate our business and the Site, or administer activities on our behalf; (b) to comply with law, or to respond to subpoenas, judicial processes, or government requests and investigations, or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; (c) to protect the security of our Site, servers, network systems, databases, and business; (d) as necessary, if we believe that there has been a violation of our Terms of Use, any other legal document or contract related to our services, or the rights of any third party; and (e) to another entity that acquires or intends to acquire us or any of our assets in connection with a sale or bankruptcy or reorganization proceeding.

8. Changes to the Eyemart Express Consumer Health Data Privacy Policy.

We reserve the right, at our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Policy at any time.
