This Privacy Policy describes the information privacy practices of Eyemart Express LLC (“Eyemart Express,” “we,” “us,” or “our”), for our brands Eyewear Express, Vision-4-Less, Vision for Less, and Visionmart Express. This Privacy Policy explains what information we collect about you; how we collect that information; the purpose for collecting it and how it benefits you; the outside parties we share it with; and your rights, including what you can do regarding your information.

This Privacy Policy describes how we treat personal information collected by or on behalf of Eyemart Express when you use our websites located at eyemartexpress.com, eyemartexpressonline.com, visionmartexpress.com, vision4less.com, visionforless.com, eyemartonline.com, eyemartoffers.com, drbarneseyewearexpress.com, and drbarneseyecare.com, as well as any other websites and platforms where this Privacy Policy is referenced or found (collectively, the “Site”); in our email messages to you relating to the Site; and in our offline interactions where this Privacy Policy is referenced. This Privacy Policy does not apply to other Eyemart Express websites or platforms that have a different privacy policy. Our Site is intended for use only in the United States and is subject to U.S. laws. If you live outside of the United States, you understand and agree that we may transfer your information to the United States.
This Privacy Policy also does not apply to protected health information (as that term is defined in the Health Insurance Portability and Accountability act of 1996, or HIPAA) we collect or create about you. Instead, our Notice of Privacy Practices applies to protected health information. Please note that most areas of the Site are not intended or designed to collect protected health information. Please do not include any health information when contacting us through the Site, except in areas where this is requested (such as when scheduling an appointment).
By accessing or using the Site, you confirm that you have read, understand and acknowledge the terms of this Privacy Policy, and agree to our Terms of Use.
1. We collect and use personal information about you.
We (and the vendors that perform services on our behalf and other parties) collect, receive, and develop several different types of personal information about you depending on the nature of your interactions with us. For example, we collect:
Identifiers/Contact Information: We may collect your name, email address, social media handles, mailing address, zip/postal code, and phone number. If you create an account, we also collect your username and password. We also collect identifiers that you post to our Site.
Internet and Network Activity Information: We may collect your IP address when you visit our Site. We also use tracking tools like cookies and pixels to passively collect information about how you interact with our Site and online content. This might include device identifiers, the type of browser and operating system you are using, your browsing and search history on our Site, what areas of our Site you visit and for how long, what products or content you view and click on, what site you came from to get to us and what site you go to when you leave us, and your interactions with our digital ads and content on other sites. We may engage or otherwise allow other parties to also collect information on our Site in these ways.
Location Information: We may passively collect information about your geolocation when you access our Site. We also collect information about your location using your IP address and your zip code, such as when you search online for product retailers near you.
Demographic Information: We may collect demographic information, such as your age, date of birth or gender. We might also collect information about the age ranges of others in your household.
Employment-Related Information: If you apply for a job, we may collect information about your work experience and previous employment, your education history, your resume, the URL to your personal or professional websites, your workplace skill sets and certifications, whether you need a visa to work in the United States, and salary expectations. If you apply for a job, you can choose to also voluntarily provide any of the following information: ethnicity, gender, disability status, and/or veteran status.
Visual/Audio Information: For example, we may record audio during customer service calls.
Sensitive Information: We may collect information that may be considered sensitive personal information under certain state or local laws. For example, we may collect information that reveals citizenship status, race, ethnicity, religion, or trade union status. We may also collect your precise geolocation and the username and password any account you create with us.
Information you submit or post: We collect feedback and any other information you provide when you contact us.
We collect and develop Inferences. Using the other pieces of personal information collected about you, we draw inferences about you, reflecting what we believe to be your preferences, characteristics, predispositions, and attitudes.
2. We use personal information for the purposes described below.
We use personal information for marketing purposes. For example, we use your information to tailor and send you information about new products and special offers. We also use information to tailor and serve you ads about products and offers. These might be offers from Eyemart Express or others and might include brands, products or services we think you would find interesting.
We use personal information to develop and improve our products and services. We may use your information to make our Site and products better. We use your information to customize your experience. We may also use your information to conduct research and to develop new products and services.
We use personal information to communicate with you and respond to your requests or questions. We use your information to respond to your questions, complaints, and feedback. We might also use your information to contact you about this Privacy Policy or our Terms of Use.

We will use certain pieces of information to verify your identity if you make requests pursuant to this Privacy Policy. The verification steps and the pieces of information that we request may vary depending on the sensitivity and nature of your request.
We use information as otherwise permitted or required by law or as we may notify you.
3. We collect personal information about you from various sources, directly and indirectly.
We collect personal information directly from you. For example, we may collect information when you register an account or otherwise contact us.
We collect personal information from your devices. We use technical tracking tools that work behind the scenes, like browser cookies, beacons, and pixels, to automatically collect information from and about you and your devices. We collect this information when you interact with our Site, our ads, and our emails that we or our vendors send to you. We collect this information about users over time and across devices.
We get personal information from vendors we hire to work on our behalf. For example, vendors that host or maintain our Site and send promotional emails for us may give us information. Our employment and recruiting vendors also give us information.
We get personal information about you from other parties. We work with business and marketing partners and social media platforms that give us information about you that they have collected either directly or indirectly from you. We may also receive information from a job network or social network if you choose to import your information from those platforms when applying for a job with us.
We combine information about you in a variety of ways. We combine information collected offline with information collected online. We may combine information that we have collected across other Eyemart Express brand websites an outside party sites, in each case where permissible by applicable law. We also combine information collected across devices, such as computers and mobile devices. These actions allow us to understand your consumer preferences more holistically. We may also combine your information with other consumers’ information to understand preferences and trends over time.
4. We share personal information with other parties.
We share personal information with vendors that perform services on our behalf for our own business and operational purposes. For example, we may share information with vendors that send emails for us, run our Site, provide advertising or marketing services, track advertising impressions, provide analytics services, investigate and prevent data incidents, audit our business and financial statements, vet job applicants, provide legal advice, or place our advertisements on other platforms.
We may share your personal information with business partners and marketing companies. For example, we may share information with other parties that co-sponsor a promotion or sell our products. These partners may send you marketing information including by mail or email. We may also share information with business partners in whose products or services you may be interested and they may use the information for their own marketing purposes or the marketing purposes of others. We may share personal information with any successor to all or part of our business. For example, if part of our business is sold, we may give our customer database to the buyer of the business as part of that transaction. We may also share information if any such transaction is proposed.
We may share information for other reasons we may describe to you or as permitted or required by law.
5. You have choices and rights regarding our use of your personal information.
You can opt-out of receiving our marketing emails. To stop receiving our promotional emails, follow the instructions in any promotional message you get from us. Some of our websites allow you to modify your preferences to opt-out. Even if you opt-out of getting marketing messages, we will still send you transactional messages, such as responses to your questions.

This California Privacy Notice applies to California residents and provides certain details regarding how we handle your personal information and the rights you have as a California resident regarding your information. This California Privacy Notice supplements our Privacy Policy.

We collect and use these categories of personal information for the business and commercial purposes described in Section 2 of this Privacy Policy and as provided below:
- Performing services, including maintaining or servicing accounts, providing customer service, providing analytics services, providing storage, or providing similar services;
- Advertising and marketing;
- Auditing, including relating to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;
- Short-term transient use, such as non-personalized advertising shown as part of a current interaction with us;

- Undertaking activities to verify or maintain the quality or safety of our services;

- To conduct business analysis;

We may disclose each of the foregoing categories of personal information for our business and commercial purposes to the extent permitted by applicable law to the categories of parties as described in Section 4 of this Privacy Policy, which may include, for example, our Family of Brands; suppliers and service providers; business and advertising partners; advertising networks; operating systems and platforms; data analytics providers; social networks; and other parties in connection with business transfers and legal, safety, fraud prevention, and enforcement reasons. We also disclose categories of personal information as we may describe to you from time to time or as permitted or required by law. We may “sell” or “share” (as such terms are defined in the California Consumer Privacy Act) the following categories of personal information, including for cross-context behavioral advertising: identifiers and contact information; personal records; personal characteristics or traits; commercial information; internet and other electronic network usage information; geolocation information; audiovisual and similar information; and inferences. We may “sell” or “share” these categories of personal information to or with the categories of third parties described in Section 4 of this Privacy Policy. We do so for the commercial or business purposes described in Section 2 of this Privacy Policy.
We will retain each category of personal information specified above for as long as reasonably necessary to carry out the business and commercial purposes described in this Privacy Policy or any other notice provided at the time of data collection, as necessary to provide our goods and services, and as necessary to comply with our legal obligations, resolve disputes, protect and defend our legal rights, and enforce our agreements.
6.2. Your California Privacy Rights.

- Deletion – You can request that we delete the personal information that we collected from you, subject to certain exceptions.
- Correction – You can request that we correct inaccurate personal information that we maintain about you, subject to certain exceptions.
- Limit the Use/Disclosure of Sensitive Personal Information – You can request that we limit the use or disclosure of your sensitive personal information to those purposes set forth in applicable California law, subject to certain exceptions.
- Do Not Sell or Share My Personal Information – You can request that we not sell or share your personal information to a third party by clicking here. For purposes of this Section 6, “sell” means the sale, rental, release, disclosure, dissemination, availability, transfer, or other oral, written, or electronic communication of your personal information to an outside party for monetary or other valuable consideration, subject to certain exceptions in applicable law. For purposes of this Section 6, “share” means transferring, making available or otherwise disclosing your personal information to another party for purposes of sending advertising to you based on your personal information obtained from your activities across distinctly-branded sites. We will not discriminate against you because you exercised any of these rights.

We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.
We will take reasonable steps to verify your identity prior to responding to certain of your requests. The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us.
You may designate an authorized agent to make a request on your behalf. When submitting the request, please ensure the authorized agent is identified as an authorized agent.
From time to time, we may collect personal information, such as email addresses, in connection with a promotion, offer or discount. Our offers and incentives generally reflect the value of the relationships that we have with the individuals who participate in these programs. Participation in these programs is voluntary and you may withdraw at any time by emailing us at privacyofficer@eyemartexpress.com, or by calling us at 1-888-372-2763.
In addition to the above, if you reside in California, you also have the right to ask us one time each year if we have disclosed personal information to third parties for their direct marketing purposes. 7. Your Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia Privacy Rights.
If you are a resident of Colorado, Connecticut, Montana, Oregon, Texas, Utah, or Virginia you may make the following requests with respect to your personal information in accordance with applicable law and subject to exceptions set forth in such applicable laws:
- Access: You can request to confirm whether we process your personal information. Subject to certain exceptions, you can also request a copy of your personal information. You may also request that we provide a list of third parties to which we disclosed personal information as set forth under applicable law.
- Deletion: You can request that we delete personal information we have from or about you, subject to certain exceptions.
- Correction: You can request that we correct inaccurate personal information we maintain about you, subject to certain exceptions.
- Opt-Out of Sale: We may “sell” personal information about Colorado and Connecticut residents as the term is defined under applicable state laws. You can request to opt out of the sale of your personal information to a third party.
- Opt-Out of Targeted Advertising: We may use personal information obtained (or in some instances inferred) from your activities across unaffiliated sites to send more relevant advertising to you. You can request that we stop using your personal information for such targeted advertising.

We may deny certain requests and will explain why your request was denied and how to appeal our decision, as required by applicable law. After receiving our explanation, if you would like to appeal our decision, you may do so as further detailed in our communication back to you. If you are a resident of Colorado or Connecticut, you may designate an agent to submit an opt-out of sale and opt-out of targeted advertising request on your behalf. Proof to verify your identity and the authorized agent’s authority to submit requests on your behalf is required, or we may deny the request. We use commercially reasonable efforts to authenticate your identity and the authorized agent’s authority through the written documentation provided in connection with the opt-out request in accordance with this Privacy Policy.
From time to time, we or our vendors on our behalf may collect personal information in connection with a promotion, offer, program, discount or other benefits. We or our vendors may disclose such personal information to the categories of third parties described in Section 4 of this Privacy Policy.
8. Our Site is intended for individuals in the United States.
Our Site is hosted in the United States and is intended for United States visitors. If you are visiting from outside the United States, note that United States laws may not provide the same level of protections as those in your own country. If you access our Site from outside of the United States, you understand, consent, and agree that we may transfer your personal information to the United States. We may also process, share, transfer and store personal information on servers located in countries other than the United States.
9. Our Site is not intended for children.
We do not knowingly collect personal information from children under 16. The Internet is not 100% secure. We cannot promise that your use of our Site will be completely safe. We encourage you to use caution when using the Internet. This includes not sharing your passwords.
We may link to other sites or outside party services on platforms we do not control.
If you click on a link to an outside party site, you will be taken to websites or platforms we do not control. This Privacy Policy does not apply to the privacy practices of that website or platform. Read the privacy policies of other websites and companies carefully. We are not responsible for these outside party practices.
We keep personal information as long as reasonably necessary to carry out the business and commercial purposes described in this Privacy Policy or any other notice provided at the time of data collection, to provide our goods and services, and as necessary to comply with our legal obligations, resolve disputes, protect and defend our legal rights, and enforce our agreements.
